On the 4th Monday of each August, the Benton County Collector offers real estate with two or more years of delinquent taxes at auction in accordance with Chapter 140 of the Revised Statutes of Missouri. The yearly tax sale encourages development of unused property and ensures that taxing districts receive as much of their expected revenue as possible. The auction will be held in the upstairs courtroom of the Benton County Courthouse in downtown Warsaw, MO.
If you are the winning bidder, you will receive a Certificate of Purchase which serves as a tax lien on the property and entitles you to a Collector's Deed after a waiting period has elapsed and you have fulfilled all of the requirements in Section 140.405 of the Revised Statutes of Missouri. At any time during the waiting period, the original owner can redeem their property and you will receive a full refund with interest.
If you are a full-time Missouri resident, all you need to do is submit a bidder registration form. You can also register at the Collector's Office on the day of the sale.Bidder Registration (PDF)
If you are not a Missouri resident, you need to find a resident of Benton County who can bid on your behalf. Both you and your agent will need to submit affidavits. Your agent will need to perform all of the steps to receive a Collector's Deed and it will be issued in their name only. They will then need to quit-claim it to you.Non-resident Affidavit (PDF) Agent Affidavit (PDF)
If you are a resident of Benton County and would like to bid on behalf of someone who does not live in Missouri, please submit a bidder registration and an agent affidavit.
